custody ?

Can you answer bn2nice’s question about Divorce?:

forever I’ve had physical custody of my daughter, but up until 4yrs ago, he stopped picking her up and acknowledging her, so my question is because its been that long do I automatically have full custody or do I have to tell the courts?

    Divorce Feedback: You will have to file a petition. Depends on the state too. When my kids biological mom hadn’t made contact in a year we filed a petition of abandoment and that opened the way for me to adopt them (I was the stepmom, now legal mom)

    Divorce Feedback: You need to tell the court and get it official.You’ll have no problem doing that but get a record of it.Could save you a lot of trouble later on.

    Divorce Feedback: there are different types of custody . legal custody, physical custody, sole custody, and joint custody.very important to realise if you have physical custody you can easily file for sole custody.Courts generally won’t hesitate to award sole physical custody to parent which is in physical possession and providing the care for child .
